This article provides a comparative legal analysis of women’s rights and freedoms in mudarabah agreements on the basis of the “Hidaya” and the legislation of the Republic of Uzbekistan. The study examines women’s participation in property relations, their engagement in entrepreneurial activities, and their legal status within investment partnerships under Islamic law. Furthermore, the article scientifically explores the similarities and differences between the civil, family, and business law provisions of the Republic of Uzbekistan and the fiqh principles set forth in “Hidaya”. Particular attention is given to the reflection of women’s economic freedom, inviolability of property, and contractual rights in both national and Islamic legal sources. As a result of the research, common principles between the modern legal system and Hanafi jurisprudence are identified, and conclusions are drawn regarding their practical significance.
