FACTUAL CONTROL OVER DIGITAL INSTRUMENTS AS AN EVIDENTIARY CRITERION IN CYBERCRIME INVESTIGATIONS

Annotatsiya

This article examines factual control over a digital instrument as a key evidentiary issue in cybercrime investigations. It argues that formal ownership of a bank card, SIM card, account, IP address, electronic wallet, or crypto wallet cannot by itself establish a person’s involvement, unless supported by technical, registration, behavioural, and financial-transactional indicators. The article proposes a verification model based on the sequence “instrument – access – action – disposition – benefit” to link digital traces with the actual user of the relevant digital instrument.
