This article presents a comparative analysis of the legal mechanisms for protecting freedom of speech in the United States and Germany. The purpose of the study is to identify differences in approaches to ensuring freedom of speech in these countries, taking into account their unique historical, legal, and cultural contexts. The main legal provisions regulating freedom of speech are examined, including constitutional guarantees, judicial precedents, and legislative restrictions. Special attention is given to aspects such as the regulation of hate speech, the balance between freedom of expression and public interests, and the influence of human rights on national legal systems.
