This article provides a private-law analysis of the relationship between the legal and illegal use of trademarks as means of individualization. The relevance of the study is driven by the rise of digital infringements and counterfeiting, which demand improved legal protection mechanisms. The purpose is to comprehensively examine the boundaries of lawful trademark use and the qualification of exclusive-rights violations, with regard to the national legislation of the Republic of Uzbekistan and international standards. The research applies normative legal analysis, comparative law methods, and case law review. The results indicate that effective trademark protection relies on civil-law measures (exclusive rights, damages, statutory compensation), complemented by administrative and criminal sanctions for willful infringements. The article discusses modern challenges – cybersquatting, unauthorized use of marks in metaverses and NFTs – and suggests ways to adapt legal mechanisms to new technologies based on international experience.
