Transnational Organized Crime and International Criminal Justice, Challenges, Frameworks, and Pathways to Effective Global Response

Transnational organized crime (TOC) represents one of the most formidable challenges confronting contemporary international criminal justice systems. Operating across porous borders and exploiting gaps in legal jurisdiction, criminal networks engaged in drug trafficking, human smuggling, cybercrime, and arms proliferation undermine state sovereignty and rule of law. This article examines the structural, legal, and institutional dimensions of TOC through a mixed-methods approach, analyzing international legal instruments, case law, and comparative national legislative responses. The findings reveal significant fragmentation in the global justice architecture, weakened extradition mechanisms, and asymmetries in law enforcement capacity across jurisdictions. The study concludes that enhanced multilateral cooperation, harmonization of legal standards, and sustained investment in institutional capacity are indispensable for an effective global criminal justice response to transnational organized crime.
