The article considers the issuance of state secrets as the objective side of treason. Based on the fact that in the theory of criminal law there are points of view according to which there are certain disagreements between the concepts of “transfer” and “issuance of state secrets,” the author was able to prove which terminology is more successful. The author proposed a doctrinal concept of improving the criminal law in the field of criminal liability for treason.
