DEPRIVATION OF MILITARY OR SPECIAL TITLE: BASIS OF APPOINTMENT AND PROBLEMS OF IMPROVEMENT

In this article, the author covered the issues of depriving a military or special rank: the basis of appointment and improvement. According to the author, "deprivation of military or special rank and deprivation of certain rights are additional punishments. Therefore, in essence, additional punishments may or may not be imposed as an additional punishment to the main punishment. According to Article 161 of the Criminal-Executive Code of the Republic of Uzbekistan, the court that issued a sentence on depriving a prisoner of a military or special rank sends a copy of the sentence to the body that granted this rank. A copy of the judgment against the reservist is sent to the defense department at his place of residence. Military courts, following the principle of humanitarianism enshrined in Article 7 of the Criminal Code, inform the prisoner himself or another person who is in prison and has been sentenced to deprivation of liberty, that the sentence has entered into legal force. Various procedural issues may arise during the execution of the judgment, i.e. during its execution or later, during its actual execution. They are decided by a military court on the basis of petitions and submissions of a sentenced military serviceman or other citizen, an authorized state agency or the public. The author says that in the analysis of the issues of imposing an additional punishment in the form of deprivation of a military or special rank of the criminal code, it is necessary to improve the issue of deprivation of a special rank.
