This article discusses the problems of legislative regulation of the process of seizing land plots for state and public needs, as well as issues related to ensuring the right to private property, an overview of the current legislation governing the regulation of the right to private property. The scientific polemic of domestic and foreign scientists on the topic under consideration is presented. An in-depth analysis of the current legislation on the acquisition of land plots for state and public needs has been carried out. Studied the positive experience of countries with developed economies regarding the issue of land acquisition for state and public needs. On the basis of the analysis carried out, proposals were made on amendments and additions to the relevant regulatory legal acts regulating the issues of seizure of land plots for state and public needs.
