Legal Regulation of Transboundary Water Resources under International Frameworks and Legislative Gaps

This research examines the legal regulation of transboundary water resources through a critical analysis of existing international frameworks and persistent legislative gaps. The study highlights the growing tension between sovereign water rights and the collective need for cooperative resource management across national borders. Using a qualitative, document-based methodology, the study reviews key multilateral treaties, customary international law principles, and selected national water legislation, including Uzbekistan's Water Code. The findings reveal that while foundational principles such as equitable utilization and no-harm duty are widely recognized, their application remains inconsistent and enforcement mechanisms are largely absent. The study concludes that closing legislative gaps requires stronger institutional frameworks, binding dispute resolution mechanisms, and enhanced interstate cooperation to ensure sustainable and equitable access to shared water resources in an era of mounting environmental pressure.
