The article is devoted to the analysis of the essence of the concepts of "complaint" and "petition" in the criminal process. The legal aspects of filing complaints and requests, their forms (oral and written), as well as the procedural features of their consideration are considered. The relationship between the participants in the process, which arises when filing a complaint or application, and the changing legal status of the subjects is emphasized. Particular attention was paid to the problems of recording oral appeals, shortcomings in the procedures for submitting complaints and requests, as well as their practical consequences. The opinions of leading scientists are presented, their compliance with the legislation and judicial practice is analyzed. In conclusion, the definition of the concepts of "complaint" and "petition" in the context of the criminal process is given, as well as the key requirements for their registration and submission are discussed.
