COMPARATIVE LEGAL ANALYSIS OF THE OBJECTIVE SIDE OF CRIME AND THE CONCEPTION OF "ACTUS REUS": PROBLEM AND PROPOSAL

In this article, such research methods were widely used as logical, systemic, comparative legal. In particular, first of all, scientific views on the objective side of the corpus delicti and the concept of "actus reus" in the doctrine of criminal law that existing in the continental (Romano-Germanic) and Anglo-Saxon (general) legal families, which are the most numerous legal families. They were described in detail. and studies by scholars of each legal family about them, the similarities as well as the differences between them. Also, a comparative legal analysis of the objective side of the corpus delicti and the concept of "actus reus" was carried out and their problematic aspects were consistently described. This article focuses on the advantages of the objective side of the corpus delicti and the shortcomings of the theory of "corpus delicti" consisting of a criminal act based on "actus reus-mens rea", in criminal law in the Anglo-Saxon family of law as theoretically, as well as practically. Along with this, the scientific works of researchers of the doctrine of criminal law were used, in the family of the Anglo-Saxon family of (common) law J. Austin, M. Moore, D.N.Husak, J.Fletcher, H.Morris, M.Gore, A.Enker, W.Blackstone, Gl.Williams and the works of Russian scientists A.N.Trainin, N.F. Kuznetsova, V.N.Kudryavtsev, D.M.Molchanov and others belonging to the continental (Romano-Germanic) family of law, as well as domestic scientists A.S.Yakubov, M.Kh.Rustamboeva, S.S.Naimov, M.Usmonaliev and P.Bakunov and others. In addition, the criminal legislation of the countries belonging to the continental (Romano-Germanic) and Anglo-Saxon (common) legal families was analyzed and, on the basis of this, specific proposals and recommendations were developed to improve the criminal legislation of the Republic of Uzbekistan.
