ACT CONTAINING SOCIALLY DANGEROUS BEHAVIOR AS A CRIMINAL ACTIVITY: THEORETICAL AND PRACTICAL ASPECTS

Аннотация
The article widely used logical, inductive, deductive, systematic, logical-legal, comparative-legal research methods. In particular, first of all, it refers to an act (action or inaction) consisting of a socially dangerous act. The interaction of external objective laws and forces with a socially dangerous action were described in detail, as well as the scientific views and research of scientists on this subject, the similarities and differences between them. At the same time, a socially dangerous action was compared with external objective laws and forces, its problematic aspects were identified and consistently described. In particular, the analysis of existing scientific research, works, scientific approaches of scientists in the criminal law doctrine shows that the concept of a socially dangerous act (action or inaction) existing in theory and criminal law cannot fully cover and not reflect the criminal behavior of a person. From this point of view, it is specified that a criminal act (action or inaction) causes only damage to protected criminal legal objects or a real danger of causing harm to them in combination with external objective (natural) forces and laws. Also, relevant criminal case materials and judgments were analyzed and it was successively described that a socially dangerous act (action or inaction) damages the objects protected by the criminal law only in combination with external objective (natural) forces and laws. The doctrine of criminal law and existing scientific research were also analyzed, and well-founded theoretical proposals and recommendations on this matter were developed.
