LEGAL REGULATION OF THE OBLIGATION TO RETURN ILL-GOTTEN WEALTH

Аннотация
This article is devoted to the problems of acquiring wealth based on unjust ownership of property or saving of property. The author thoroughly analyzes the theory of "real" and "legal" enrichment available in science, and mentions that these theories mean the concepts of unjust enrichment from the use of property with legal ownership and without legal ownership. In this context, the author points out that the subject of unjust enrichment can be things of a general and personal nature. The author critically evaluates the fact that only property can be the subject of unjustified wealth acquisition, while in practice the benefits that gain economic value can also be the subject of fundamental wealth acquisition and it is covered by the objects of civil law.
