THE CONCEPT OF VIOLATION OF CUSTOMS LEGISLATION AND THE DEVELOPMENT OF LEGISLATION PROVIDING FOR CRIMINAL LIABILITY FOR THIS ACT

Аннотация
This article analyzes the concept of violation of customs legislation and the stages of development of legislation that provides for criminal liability for this act. As a result of the development of commodity-money relations and mutual relations between countries in trade and other spheres, countries have felt the need for border and customs services in almost all periods. Through this study, the opinions of scientists regarding the concept of violation of the customs legislation, the norms of the national criminal legislation, the explanations given by the Plenum of the Supreme Court of the Republic of Uzbekistan were analyzed. The social necessity of determining responsibility for this crime is justified. It also focuses on the different aspects of this crime from other types of crimes. In addition, this article analyzes in detail the issue of responsibility for the crime of violation of customs legislation in the periods of development of national statehood in our country, including Islamic law, khanates, emirate era, Soviet system and independence. Among them, the criminal laws of 1926, 1959, and 1994, which are in force in Uzbekistan, analyze the norms that define responsibility for crimes related to the violation of customs legislation, and highlight the different aspects of these norms from the norms defined in the current criminal law. As a result of the research, the author developed a definition of the concept of violation of the customs legislation and recommended to study separately the stages of development of the legal documents that provide criminal responsibility for this act.
