PROPERTY RIGHTS AS OBJECTS OF CIVIL RIGHTS: PROBLEMS OF DETERMINING THEIR PLACE IN THE SYSTEM OF OBJECTS

The article examines the place of property rights within the system of objects of civil rights under Article 81 of the Civil Code of the Republic of Uzbekistan. The relationship between the concepts of property, thing, property right and real right is explored through literal, systemic, logical and comparative legal interpretation. The dual role of a property right—as a subjective right and as an independently transferable object with economic value—is analyzed through the “right to a right” construction. Uzbekistan’s legislative model is compared with the approaches adopted in Ukraine, Russia and selected continental legal systems.
