Abstract
The article highlights the main differences between cases where the accused has a chronic but curable disease that excludes his complicity in the settlement of the case, and when the criminal case is closed on other grounds. An important feature of the complex basis is that the person who committed the crime is clearly identified and his act is proven by the evidence in the criminal case, and the experience of foreign countries, some problematic situations encountered in the investigative practice related to this basis, and the errors and omissions made are analyzed in depth, this problem and Reasoned suggestions for eliminating shortcomings have been developed.
