ILLEGAL PRODUCTION OR TRAFFICKING OF ETHYL ALCOHOL OR ALCOHOLIC BEVERAGES: ISSUES OF CRIMINAL LIABILITY AND DIFFERENCES FROM SOME SIMILAR ACTS

The article presents some of the author's considerations on certain issues of criminal liability for the illegal production of ethyl alcohol or alcoholic beverages or their introduction into circulation and differences from some similar acts. The author also notes that all over the world, the production and sale of ethyl alcohol and alcoholic beverages in accordance with the law are important for ensuring public health and safety, protecting the economy and maintaining public order. Scientific research on the factors of public danger of illicit trafficking or production of ethyl alcohol and alcoholic products has mainly studied the negative impact on public health, the link between organized crime and the negative impact of illegal trade in ethyl alcohol and alcoholic products on the economy. In the course of this small study, the author notes that although the components of crimes are similar to each other, they differ from each other in many ways. It notes the need to take these differences into account, especially when qualifying an act. Similarly, the article notes the differences between the crime of manufacturing or introducing ethyl alcohol or alcoholic products into circulation from some similar acts and the following conclusions on the qualification of such acts: firstly, the role of completeness and quality of preliminary investigation in the correct qualification of these crimes is invaluable; secondly, in most cases, acts of this category are committed not by themselves, but in combination with other crimes; Thirdly, one of the most favorable circumstances is that it is advisable to provide an appropriate explanation in the Resolution of the Plenum of the Supreme Court regulating these crimes. Because this entails the introduction of uniformity, certainty in solving conflict relations, other problematic situations and in solving each given type of crime.
