LEGAL SUPPORT OF PREVENTIVE MEASURES IN THE MECHANISM OF ENVIRONMENTAL PROTECTION

Аннотация
Preventive measures guarantee the environmental rights and interests of individuals and legal entities, and also contribute to improving the effectiveness of the implementation of the legislative framework of the state's environmental policy. Preventive measures contribute to the prevention and elimination of the consequences of activities that harm the environment and humans, the restoration of destroyed ecosystems and components. The system of organizational and preventive measures includes the following components: environmental control, environmental regulation, environmental impact assessment, environmental expertise, environmental audit, environmental certification, certification of industrial and economic facilities, licensing of environmentally significant activities, environmental education and upbringing system, public participation in making environmentally significant decisions. Environmental control can be viewed from two perspectives. Firstly, as a function of environmental protection management. In this sense, it is an independent type of activity, the content of which includes the collection of information about controlled objects, its processing, evaluation and transfer for making managerial decisions for predetermined purposes. Secondly, as a guarantee of the implementation of environmental measures and the implementation of their regulatory legal measures, a way to ensure legality in environmental management.
