THE CONCEPT OF MITIGATING CIRCUMSTANCES AND ITS CHARACTERISTICS

In this article, the author touched on issues related to the concept of mitigating circumstances and its signs. The article also discussed the fact that insufficient assessment of mitigating circumstances by the courts at the time of sentencing leads to errors in the application of the law, and as a result, unjustified sentencing of a person or inappropriate mitigation by taking into account mitigating circumstances. In addition, the article examines the problems related to mitigating circumstances and analyzes the opinion of scientists in this regard.
