CRIMINAL LIABILITY FOR INDUCING THE USE OF NARCOTIC DRUGS, THEIR ANALOGUES, OR PSYCHOTROPIC SUBSTANCES: FOREIGN EXPERIENCE

This article analyzes the issues of criminal liability for inducing the use of narcotic drugs, their analogues, or psychotropic substances based on the experience of foreign countries. In particular, the legal provisions of Germany, Kazakhstan, Russia, the United States, France, Japan, South Korea, Australia, and China are examined, and a comparative legal analysis is conducted regarding the types of liability and sanctions established for such acts in these jurisdictions. Special attention is paid to the specific features of the criminalization of inducing the use of narcotic drugs and psychotropic substances in foreign legislation. The article explores the legal regulation of this conduct in each country in conjunction with international legal standards, including the requirements of the 1988 United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances. Based on the results of the comparative legal analysis, the possibilities of implementing the most effective foreign legal mechanisms into the legislation of the Republic of Uzbekistan are assessed, and conclusions and recommendations aimed at increasing the effectiveness of combating such crimes are proposed.
