THE EVOLUTION OF THE SUBJECT OF CRIME IN THE CONTEXT OF TECHNOLOGICAL PROGRESS: ARTIFICIAL INTELLIGENCE, CRYPTO-ASSETS, VIRTUAL PROPERTY, AND INFORMATION AS OBJECTS OF CRIMINAL INFRINGEMENT

This article provides a comprehensive scientific analysis of the legal nature and evolutionary changes of the subject of crime in criminal law in the context of global technological progress and digital transformation. In particular, the role and socio-legal status of artificial intelligence systems, crypto-assets, virtual property, and information as independent subjects of crime are revealed. The author investigates the theoretical and practical problems arising from the transition of the traditional concept of a material subject of crime into the digital space, using the experience of foreign countries and national judicial practice. At the same time, the article scientifically predicts the risks of neuro-data, real estate and assets in the metaverse, cybernetic analogs of critical infrastructure facilities, and genomic data becoming objects of criminal infringement in the near future. Based on the results of a survey conducted among practitioners, a number of well-founded, specific legislative proposals for improving the Criminal Code of the Republic of Uzbekistan have been put forward. Special attention is paid to the proper qualification of cybercrimes, the reliable protection of citizens' digital property rights, and the introduction of innovative legal mechanisms into criminal legislation.
