A CRIMINAL LAW MODEL FOR DISTINGUISHING DIGITAL PROPERTY OFFENCES FROM RELATED CRIMINAL OFFENCES

Abstract
The article examines the criteria for distinguishing property offences committed using information technologies from related criminal offences. Its purpose is to develop a model of legal characterisation based not on the technology employed but on the legal mechanism that produces the property consequence. Using formal legal, systemic and comparative legal methods, the study analyses the victim’s volitional participation, coercion, the offender’s authority over property and information systems, the time at which criminal intent is formed, and independent harm to computer information. It proposes a six-stage model for characterising digital property offences and substantiates criteria for distinguishing fraud from extortion, embezzlement, theft, causing property damage and offences involving computer information.
