LIVING QUARTERS AS AN OBJECT OF PROPERTY RELATIONS BETWEEN SPOUSES

Abstract

The article analyses the norms of civil, family and housing legislation, concerning the division of property by spouses, including residential premises upon dissolution of marriage. The article also defines the concepts of "common property of spouses", "shared property" and "living quarters" according the legislation of the Republic of Uzbekistan. It cites statistics from the Supreme Court of the Republic of Uzbekistan on occupancy of housing and eviction from housing. One example is given of a court decision handed down by the Uchtepa inter-district court for civil cases in Tashkent concerning occupancy of a house, and the grounds for the legislation on which the decision was based.
