MITIGATING FACTORS AND CRIMINAL DEFENSES IN THE CRIMINAL CODE OF THE REPUBLIC OF BULGARIA (COMPARATIVE ANALYSIS)

This paper is dedicated to comparative analysis of the existing edition of the Criminal Code of the Republic of Bulgaria and Criminal Code of the Republic of Uzbekistan in terms of consideration of the mitigating factors and criminal defenses. In this regard, the institute of mitigation of punishment as a whole has been considered, including the issues on determining the punishment for the criminal offences committed in mental disorder, for incompleted offences and complicity, as well as features of minors’ responsibility and voluntary rejection from offence. Pursuant to the results of the performed analysis, similar and different sides of foregoing criminal laws have been clarified, decisions on the concluded analysis and final conclusion on the implementation of some of the Bulgarian criminal law norms to the criminal law of the Republic of Uzbekistan has been provided.
