GENERAL CHARACTERISTICS OF TERMINATION OF EMPLOYMENT CONTRACT DUE TO CIRCUMSTANCES BEYOND THE CONTROL OF THE PARTIES

Аннотация
This article discusses the application of the concepts of “termination of an employment contract”, “suspension of an employment contract” and “dismissal”, as well as termination of an employment contract due to circumstances beyond the control of the parties, as one of the grounds for termination of the employment contract. Despite the fact that the Labor Code of the Republic of Uzbekistan clearly defines cases of termination of the employment contract due to circumstances beyond the control of the parties, it was also found that there is no mechanism to ensure compliance with these grounds. In particular, the absence of grounds, procedure and terms for termination of the employment contract, as well as the absence of reference norms regarding this issue in other regulatory legal acts was found. In addition, the issues of termination of the employment contract due to circumstances beyond the control of the parties under the labor legislation of foreign countries were studied.
