ANALYSIS OF LEGAL RELATIONS REGARDING THE PROVISION OF HUMAN RIGHTS, FREEDOMS AND LEGITIMATE INTERESTS IN OPERATIONAL-SEARCH ACTIVITIES

Аннотация
The article analyzes that the organizational activities of the practice staff to ensure human rights, freedoms and legitimate interests in operational investigative activities do not fully meet the requirements of the time, based on empirical material and the study of the problems faced by the practice. The author's definition of the concept of “operational search relations” was developed on this issue, which entered into a scientific dispute with the opinions of more than twenty legal scholars. The author believes that with the rapid and complete detection of crimes, in the issue of collecting optimal evidence without the human factor, it is important not only to obtain recognition of the individual, but also to focus on organizing activities in an approach to prioritizing proving one's guilt with other evidence in modern forensic and forensic research, the widespread use of information technology, as well as, The Higher Attestation Commission of most CIS countries, in accordance with the list of specialties of the established branch of legal sciences and the name of the specialties taught at the departments of “Criminalistics and Forensic examination” and “Operational search activities” established in law enforcement institutions of higher education, defines the name of the specialty “12.00.09” as “Criminal procedure. Criminalistics and forensic examination; operational search activities”, a proposal was put forward to create a “Scientific and educational portal of operational search activities” to conduct research in these areas.
