MODERN APPROACHES TO IMPROVING LEGISLATIVE QUALITY: EVIDENCE, ENFORCEABILITY AND STRATEGIC CONSISTENCY

Аннотация
The article examines legislative quality as an integrated category that extends beyond the legal and technical accuracy of a normative text and combines the evidentiary basis of a regulatory decision, its practical enforceability and its consistency with the strategic objectives of the state. The article aims to systematize contemporary theoretical and institutional approaches and to develop an applied model for Uzbekistan based on the cycle “strategy – norm – implementation – outcome”. Formal legal, systemic-structural, comparative legal, functional and legal modelling methods were used. It was found that evidence-based lawmaking requires a reliable diagnosis of the problem, comparison of regulatory and non-regulatory alternatives and proportionate impact assessment. Enforceability requires powers, resources, procedures, digital infrastructure, oversight and appeal mechanisms to be designed before adoption. Strategic consistency requires a verifiable connection between the legal instrument, the strategic objective, performance indicators and budgetary capacity. The article proposes a problem passport, an alternatives matrix, a six-component enforceability test, a strategic filter, a single regulatory dossier and a sequence of ex ante, ex durante and ex post review. The scientific novelty does not lie in restating the general methodological requirements of the European Commission’s Better Regulation system and OSCE documents, but in adapting them to Uzbekistan and developing an integrated model comprising mandatory elements of a problem passport, a six-component enforceability test and memorandum, a two-level strategic filter and a single electronic regulatory dossier.
