ANALYSIS OF THE CONTENT AND BASIC PRINCIPLES OF THE RIGHT TO HEALTH IN THE SYSTEM OF INTERNATIONAL HUMAN RIGHTS LAW

Аннотация
This article provides a comparative legal analysis of the content and basic principles of the right to health, which is presented as an independent category in the system of modern international human rights law. Based on the complex legal nature of the right to health, characterized by the complex nature of regulation, it is determined that the quality of its implementation is reflected in the realization of many other human rights. At the same time, the peculiarity of the right to health is a set of individual rights and obligations, as well as state and even international obligations, which together are aimed at ensuring global and individual health. In this regard, it has been revealed that during the period of constant occurrence of special (emergency) conditions, the cornerstone problem is the question of determining a fair ratio of the rights and freedoms of an individual with another individual, or the rights, freedoms and interests of an individual with society, or the state. With these issues in mind, the basic principles of the right to health have been developed.
